The American Recovery and Reinvestment Act (ARRA) became a part of the public law on February 17th, 2009, and can be cited under section 115-5 of the public law which is also referred to as the stimulus package. As a result, incentives were also included in the ARRA act which was meant to sensitize the handling of Electronic Health Record HER by Critical Access Hospitals, hospitals, and certain Healthcare professionals (EP).

Some of the requirements on the EHR upgrade or implementation incentives and associated requirements are outlined under Division B, Title IV. The financial incentive under Title IV has been made available since (FY) 2011 (10/1/2010) for CAHs and Hospitals while for EPs it began in a calendar year (CY) 2011. Otherwise, the repercussions for failure to adhere to the EHR upgrades and such meaningful measures by 2012, the Center for Medicare and Medicaid Services (CMS) will cut down on Medicare reimbursements paid to the respective individuals or entities.

It is the CMS that drafted and finalized this meaningful use rule. Otherwise, it outlines some of the measures that are considered to demonstrate the meaningful use of EHR and also includes related requirements that an entity must meet to qualify for the Medicare EHR financial incentives.

The requirements of the rule that is in effect today are those of stage 1. Otherwise, there are three stages all of which cover different periods whereby stage two, which is quite stringent, has been delayed to 2014 and the third stage to TBA date.

The requirements of Stage 2 meaningful use notice of the suggested Rulemaking/NPRM and of Vendor Stage 2 EHR applications were published on the week of March 5, 2012, in the Federal register. The NPRM publication is normally followed by a 60 day public comment period. These comments will act as a base for reviewing and revising the draft rule before the publication is finalized. Otherwise, upon finalization, the requirements for meaningful use measures and for vendor functional or technical aspects will have to be put in place before being issued with the federal certification.
